Terms of Use

1. Fathom and eligibility

Fathom is operated under the registered business name Fathom Weather (ABN 60 567 600 591) in Western Australia. You must be legally able to agree to these Terms. If you are under the age of majority where you live, a parent or guardian must approve your use.

3. Accounts

Keep your sign-in details secure and provide accurate information. You are responsible for activity under your account. Tell us promptly if you suspect unauthorised access. You may delete your account in Profile; this permanently removes account data subject to limited legal, security, backup, and moderation retention described in our Privacy Policy.

4. Fathom Pro subscriptions

• Fathom Pro may be offered monthly or annually at the price shown in the App Store or web checkout. Available features, currency, billing period, any eligible trial, and the final total are shown before you buy.
• Payment is charged to your Apple Account when you confirm purchase. If a free trial is offered, payment begins when the trial ends unless you cancel before then.
• Your subscription renews automatically for the same period unless cancelled at least 24 hours before the current period ends. Apple may charge the renewal within 24 hours before expiry.
• Manage or cancel at any time in Apple subscription settings. Deleting your Fathom account or the app does not cancel your Apple subscription.
• Apple handles billing and refunds under its rules. Any price change is presented through Apple and applied in accordance with App Store requirements.
• Where web checkout is available, RevenueCat manages your subscription and Stripe processes payment. Web subscriptions renew automatically for the selected period until cancelled. The checkout shows when any trial ends and the first charge is due.
• Web subscriptions are currently offered only to customers in Australia and are priced in Australian dollars. We may change availability later and will show the applicable price and terms before purchase.
• For web purchases, open Profile → Subscription to manage renewal, payment details and receipts. Cancel before the next renewal to stop future charges; access normally continues through the paid period. Contact contact@fathomweather.com for web billing or refund help.
• Pro access follows the Fathom account used for purchase. Sign in with that same account on each device. Deleting an account does not cancel a subscription. Conditions alerts are delivered through the mobile app; browser push notifications are not included.

5. Sessions, comments, and community conduct

You keep ownership of content you submit. You give Fathom a non-exclusive licence to store, process, display, and moderate it only as needed to operate and protect the service.

Do not post harassment, hate, threats, sexual or exploitative material, dangerous encouragement, spam, scams, unlawful content, someone else’s private information, or content that infringes rights. Do not impersonate others, misuse reports, probe security, automate abusive access, or interfere with the service.

Fathom uses automated filters and user reports. We may remove content, limit features, suspend accounts, or terminate access when reasonably necessary for safety, legal compliance, or enforcement. Users can report comments, block abusive users, and contact contact@fathomweather.com about moderation.

6. Licence and intellectual property

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Fathom for lawful, non-commercial purposes. Fathom’s software, design, scoring logic, brand, and original content remain ours or our licensors’. You may not copy, sell, reverse engineer, scrape, or create a competing dataset from the service except where law does not allow that restriction.

7. Third-party data and services

Fathom relies on Apple, Supabase, Cloudflare, RevenueCat, Expo, Mapbox, Google, Sentry, WillyWeather, the Bureau of Meteorology, and other providers. Their services, data, and terms may affect availability. Attribution does not mean a provider endorses Fathom. Do not redistribute third-party forecast or map data except as the app expressly allows.

8. Availability and changes

We may maintain, change, add, or remove features and may suspend Fathom where needed for security, law, provider changes, or operations. We aim for a reliable service but do not promise uninterrupted or error-free access. We may update these Terms and will post the new effective date; material changes will receive reasonable notice.

9. Consumer rights and liability

Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded, including rights under the Australian Consumer Law. To the maximum extent permitted by law, Fathom is provided “as available”; we are not liable for indirect or consequential loss, lost opportunities, or loss caused by reliance on forecast output, unsafe decisions, third-party services, or events outside our reasonable control.

10. Governing law and contact

These Terms are governed by the laws of Western Australia and Australia. Courts with jurisdiction in Western Australia may hear disputes, subject to any mandatory rights you have where you live.
